Welcome to A&Y Party Rentals. By accessing our website (www.aypartyrentals.com) and booking our services, you agree to comply with and be bound by the following terms and conditions.

2. BOOKINGS & DEPOSITS

All reservations are subject to availability and are only confirmed once the required non-refundable deposit is paid. The remaining balance must be paid in full prior to or at the time of delivery, as specified in your invoice.

3. DAMAGE POLICY & EQUIPMENT CARE

The Renter is responsible for all equipment from the time of delivery until pickup. In the event of damage, one of the following protocols will apply:

• Damage Waiver: An optional fee that covers minor, accidental wear and tear. It does not cover gross negligence, theft, or damage caused by prohibited items (e.g., Silly String, face paint).

• Professional Repair: For repairable damage, the Renter agrees to pay the total cost invoiced by a third-party professional, including logistics and shipping.

• Total Replacement: If equipment is unrepairable, suffers permanent aesthetic damage (stains, cuts, chemical burns), or is lost/stolen, the Renter is responsible for the full current market replacement cost.

4. FLORIDA SAFETY & WEATHER COMPLIANCE

• Child Safety: Constant adult supervision (18+ years) is strictly required for all inflatables and interactive games.

• Weather Policy: In compliance with Florida safety standards, A&Y Party Rentals reserves the right to cancel or deflate equipment if winds exceed 15-20 mph or if lightning/heavy rain is present.

• Silly String Warning: Silly String causes permanent chemical damage to vinyl. If detected, the Total Replacement fee will be automatically applied.

5. SPECIALIZED EQUIPMENT

• Mechanical Bull: This is a high-risk activity. The Renter acknowledges inherent risks; only individuals in proper physical condition (not under the influence of alcohol/drugs) may participate.

• Throne Chairs & Luxury Furniture: These are for decorative/photographic use only. Do not move these items once installed. Stains or structural damage will be billed under Repair or Replacement protocols.

• Tents: The Renter must ensure all underground utility lines are marked before staking. Cooking under tents is strictly prohibited.

6. LIABILITY RELEASE (FLORIDA STATE LAW)

PLEASE READ CAREFULLY: By hiring A&Y Party Rentals, the Renter hereby releases, waives, and discharges A&Y Party Rentals, its owners, and employees from any and all liability for injury, disability, or death, or loss or damage to person or property, whether arising from the negligence of the releasees or otherwise, to the fullest extent permitted by the laws of the State of Florida.

7. GOVERNING LAW

These terms shall be governed by and construed in accordance with the laws of the State of Florida. Any legal actions must be filed in the courts of Jacksonville, FL.

8. CANCELLATION & REFUND POLICY

• Deposits: All deposits are non-refundable, as they secure equipment specifically for your date.

• Standard Cancellations: Cancellations made more than 7 days prior to the event will result in a credit of the deposit for a future rental (valid for 6 months). Cancellations within 48 hours result in forfeiture of the deposit and may incur a 35% cancellation fee of the total balance.

• Weather-Related (Florida Specific): We reserve the sole right to cancel installations due to unsafe weather (winds over 15-20 mph, lightning, or tropical storm warnings).

  • Before setup: Customer receives a full deposit credit for a future date.

  • After setup: No refunds or credits will be issued once equipment is installed.

• No-Show Policy: If the Renter is not present or the area is not ready, the driver will wait 15 minutes. After this, the rental is considered canceled, and the full balance will be charged.
